Plans are under way to demolish and renew unsafe and old buildings in Baku. The main criteria are not a building’s age, but its technical condition and safety risks.
“Operative Information Center-OMM” reports, citing AzTV, that the amount of compensation is one of the issues residents are most concerned about during demolition.
Residents say that if demolition is necessary, the key condition is fair compensation for property owners. They say the amount should reflect the property’s actual value.
Which areas are set for demolition?
Nearly 30 buildings are slated for demolition in the capital’s Nasimi district. The plan includes buildings on Samad Vurgun, Bulbul, Shamil Azizbeyov, Mirza Ibrahimov, Jalil Mammadguluzadeh and Sabit Rahman streets.
Up to 150 buildings are also planned for demolition in the Sabunchu, Binagadi and Surakhani districts. In Binagadi, the listed addresses include 1st Maden, 2nd Maden and 3rd Maden streets, as well as Agha Nematulla, Bagh and Aghasadiq Garaybeyli streets.
Renewal work is also planned in parts of the Narimanov, Yasamal, Khatai and Sabail districts. Work has reportedly begun at some addresses, while preparations and assessments are under way at others.
How is compensation calculated?
An expert said there are different approaches to determining compensation. The amount may be set through an assessment by a commission or by agreement between the investor and residents.
The expert stressed that compensation should be based on the market value per square meter of apartments in new buildings in the area where the demolished building is located, or within an approximately one-kilometer radius.
Accordingly, the amount of compensation and the method used to calculate it have a direct impact on residents’ rights.
How are property owners’ rights protected?
A lawyer said Article 29 of the Constitution of Azerbaijan protects property rights. According to the lawyer, no one may be deprived of property without a court decision. Property acquired for state needs must be taken in accordance with procedures established by law.
Compliance with legal procedures and protection of property owners’ right to fair compensation are essential when property is acquired.
Thus, alongside safety concerns, protecting residents’ property rights is also important as old and unsafe buildings are renewed. The criteria used to calculate compensation and ensure it reflects the property’s actual market value are particularly significant during the demolition process.
