How is it compared and taxed?

Since 2026 vacation pay may not be less than the last salary (art. 111.1). The law does not say how to compare; the calculator uses the method in the Ministry of Labour's explanation: monthly salary ÷ the month's working days × the working days inside the leave, month by month.

Vacation pay is taxed like salary: income tax, social insurance (DSMF), unemployment and compulsory medical insurance. Per the State Tax Service, the part falling in each month is added to that month's salary and taxed with it; the rest of the month is assumed worked.

Questions

How is vacation pay calculated in Azerbaijan?

The wages of the 12 months before the month the leave starts are divided by 12, then by 30.4 — the average daily pay — and multiplied by the leave's calendar days (art. 140.3). For a salary of 1,000 AZN and 21 days: 1,000 ÷ 30.4 × 21 = 690.79 AZN. Since 2026 the result may not be less than the last salary would pay for the leave's working days (art. 111.1).

What if a holiday falls during the leave?

Holidays, the national mourning day and voting days are not leave days and are not paid, but the leave is extended by as many days (art. 114.6). Saturdays and Sundays are leave days: leave is counted in calendar days.

When must vacation pay be paid?

At least 3 days before the leave starts. An employment or collective agreement may set another date, but no later than the next payday (advance or balance) (art. 140.5). If it is late, the employee may ask for the leave to start on the day of payment (art. 140.6).

Is vacation pay taxed?

Yes, like salary: income tax, social insurance, unemployment and compulsory medical insurance. The part falling in a month is added to that month's salary and taxed with it, so a leave spanning two months is taxed with both months' pay.

When can a new employee take leave?

For the first year, after six months of work (art. 131.1). Employees under 18, women before or after maternity leave, employees with a disability and a few others need not wait (art. 131.4). With less than 12 months worked, the average is taken over the full months actually worked (art. 140.2).

Can leave be split into parts?

At the employee's request and with the employer's consent, yes, but one part must be at least 14 calendar days (art. 137.1). The rest is used by the end of the work year or added to the next year's leave.

What happens to unused leave on dismissal?

Compensation is paid for every unused year, by the same formula (art. 140.4, 144.2). Under the Constitutional Court's decision of 18 February 2026, the additional leave days are compensated too. Instead of the money the employee may take the leave and make its last day the dismissal date (art. 143).
