Administrative liability for violating obligations established by the "Law on Climate" may be imposed in accordance with the Code of Administrative Offenses of the Republic of Azerbaijan.
According to the Operative Information Center-OMM, this provision is included in the draft "Law on Climate" currently presented for public discussion by the Ministry of Ecology and Natural Resources.
Under the proposed legislation, administrative penalties will apply to several specific infractions, including the failure to submit emission reports, the submission of false or distorted data, non-compliance with approved monitoring plans, failure to meet obligations regarding the Emissions Trading System (ETS) and carbon taxes, the illegal issuance of carbon credits, and violations of operational rules concerning the national carbon registry.
In cases involving forgery, document falsification, illegal profit generation, unauthorized interference with information systems, market manipulation, or other criminal elements, materials will be referred to law enforcement agencies for investigation under the Criminal Code of the Republic of Azerbaijan.
Furthermore, any damages caused to the state, market participants, or third parties as a result of violations of this law must be compensated in accordance with the civil legislation of the Republic of Azerbaijan.
This legislative initiative aligns with Azerbaijan's broader strategy to strengthen environmental governance and meet international climate commitments. As the country prepares to implement stricter environmental standards, these measures are designed to ensure transparency and accountability in carbon management and industrial emissions control.
