In Azerbaijan, pension provision for certain categories of people is governed by special rules depending on their length of service, position and the circumstances in which a disability occurred. For some, pensions and service-related supplements can amount to 80% — and, in certain cases, 100% — of their salary or allowance.
"Operativ Məlumat Mərkəzi-OMM" reports that the Law on Labor Pensions and special legal provisions for individual categories establish different pension arrangements for certain people. These rules may apply to civil servants, military personnel, law enforcement officers, judges, members of parliament and other designated categories.
However, this does not mean that all such people automatically receive pensions equal to 80% or 100% of their final salaries. The payment amount is determined by the person’s length of service, legal status, applicable pension calculation method and other conditions set out in legislation.

Who may receive a pension equal to 100% of salary?
In certain cases, pensions for military personnel and people with special ranks who are injured or become ill while performing military service or special duties, and are consequently assigned Group I disability, may be calculated on the basis of the full amount of their allowance.
Judges’ pension provision is also governed by special legal rules. Specific payment arrangements may apply, subject to certain conditions, to judges who leave office during their term because of their health or retire upon reaching the age limit.
Whether the 100% rate applies in these categories depends on the individual’s legal status and the conditions stipulated in the relevant legislation.
Who may qualify for a pension equal to 80% of salary?
Civil servants
Civil servants who meet the required length-of-service threshold may be entitled to a service-related supplement in addition to their pension. Subject to the relevant conditions, the combined payments may reach up to 80% of their average monthly salary.
Military personnel and law enforcement officers
Pensions for military personnel who complete long periods of service, as well as employees of the prosecutor’s office and other law enforcement agencies, are calculated based on their service period and allowance. In certain cases, the pension and relevant supplements may amount to up to 80% of the allowance.
Former members of the Milli Majlis and other officials
Special service-related supplements may also be provided for certain categories, including former members of parliament, the Ombudsman, and members of the Central Election Commission and the Chamber of Accounts. These payments are calculated within limits established by the relevant legislation.
Military personnel assigned Group II disability
Pension provision for people assigned Group II disability due to military service or war is also governed by special rules. In some cases, the calculation is based on the final allowance, and the 80% threshold may apply if the relevant legal conditions are met.

How is the pension amount determined?
Belonging to a special category does not mean that a person is automatically entitled to a pension equal to 80% or 100% of their final salary. The conditions set out in legislation must be met. Calculations take into account length of service, salary or allowance, the cause of disability and the person’s category.
Therefore, determining an individual’s pension requires a separate assessment of their legal status and the regulatory acts governing their pension provision.
