In Azerbaijan, people in certain categories may retire before reaching the statutory retirement age if they meet the conditions set by law. The provision applies to parents with many children, workers in hazardous and arduous jobs, civil aviation employees, military personnel and people in several other professions.
“Operative Information Center-OMM” reports, citing the Law on Labor Pensions, that the retirement age may be reduced by 5, 15 or, in some cases, 20 years, depending on a person’s category and length of service. To qualify, applicants must meet the relevant conditions and be entitled to a labor pension.
Parents with five or more children
The retirement age may be reduced by five years for women and men who have five or more children or a child with a disability. Applicants must meet the conditions set out in the law to qualify.
Children under the age of eight who have been deprived of parental care and adopted or placed under guardianship are also included in the count.
Men qualify for this benefit in certain circumstances. These include the mother’s death; her being declared dead or missing by a court; her loss of parental rights; or the child or children being placed in the father’s care following the dissolution of the marriage.
Workers in arduous and hazardous jobs
People employed in underground work, sectors with particularly hazardous and arduous working conditions, and certain areas of the arts may also qualify for preferential retirement terms.
For the relevant jobs specified by law, men must have worked for at least 12 years and six months, and women for at least 10 years. If they meet the conditions, their retirement age is reduced by five years.
However, the benefit does not automatically apply to everyone working in arduous jobs. The person’s profession and position must be included on the relevant approved list.
Who can retire 20 years earlier?
A special benefit is available to people with hypophyseal dwarfism, also known as hypopituitarism, which is associated with impaired pituitary gland function, as well as to people with dwarfism involving impaired bodily proportions.
If they have at least five years of insurance record, their general retirement age set by law may be reduced by 20 years.
Civil aviation workers can retire 15 years early
People employed in relevant positions in civil aviation flight and flight-test crews are also entitled to preferential retirement terms.
For these jobs, the retirement age is reduced by 15 years for people with at least 25 years of insurance record. Those who leave flight work for health reasons must have at least 20 years of insurance record in the relevant jobs.
What benefits are available to prosecution service employees?
Employees who have served in prosecution bodies for at least 35 years are entitled to an old-age labor pension.
People whose service in prosecution bodies ended because they reached the relevant age may also qualify if they have at least 35 years of total work experience, including at least 17 years and six months of service in prosecution bodies.
Prosecution service employees deprived of their special ranks are not eligible for this benefit.
When can military personnel retire?
Several grounds for preferential retirement apply to military personnel. Those who have completed at least 25 calendar years of service before leaving the military are entitled to an old-age labor pension as military personnel.
People discharged from military service upon reaching the relevant age may also retire if they have at least 30 years of total work experience, including at least 15 years of military service.
Additional conditions apply to those discharged because of illness, limited fitness for health reasons or staff reductions. On the date of discharge, they must be at least 48 years old, have at least 30 years of total work experience and at least 15 years of military service.
Preferential pension rights also apply to military personnel who took part in cleanup operations following the Chernobyl nuclear power plant accident in the resettlement zone and completed at least 15 years of military service.
Employees of justice, migration and emergency services
Employees serving in positions with special ranks in justice, migration and emergency services may also receive an old-age labor pension under the conditions set by law if they have at least 35 years of service.
People deprived of their special ranks are not eligible for this benefit.
How is a pension calculated after military service?
Military personnel are granted an old-age labor pension after leaving military service. As a general rule, the pension of a person who is later accepted back into military service and then discharged cannot be recalculated based on their final allowance.
However, the law provides for exceptions. These include people who serve for at least 72 months after being accepted back into military service, those reinstated by a court decision, people killed while performing military duties, and members of the senior officer corps.
It should be noted that belonging to a professional or service category alone is not enough to qualify for preferential retirement. A person’s insurance or service record, working conditions and other requirements set out in law are also taken into account.
