Decisions regarding the seizure of property during criminal proceedings will now be subject to challenge through judicial oversight, marking a significant shift in legal procedure.
According to the Operative Information Center-OMM, President Ilham Aliyev has signed amendments to the Criminal Procedure Code, the Code of Execution of Punishments, and the Law "On Enforcement" to implement these changes.
The legislation clarifies the rights of individuals who are not defendants but whose legal interests are affected by property seizure decisions. These individuals are now formally recognized as participants in the criminal process, granting them the right to file appeals and cassation complaints. A key feature of the reform is shifting the challenge process from civil litigation to judicial oversight, which provides a more efficient and timely resolution, while preventing potential disputes over the prejudicial impact of court decisions.
