Milli Majlis adopts amendments on property seizure disputes

The Milli Majlis (National Assembly) of the Republic of Azerbaijan has adopted, in the final reading, amendments allowing for judicial review of decisions made by criminal prosecution bodies regarding the seizure of property.

According to the Operative Information Center-OMM, the legislative package, which includes changes to the Criminal Procedure Code, the Code on Execution of Punishments, and the Law "On Enforcement," was discussed and approved during today's plenary session of the parliament.

The amendments clarify the legal status of individuals who are not accused in a criminal case but whose legal interests are affected by property seizure decisions. These individuals will now be classified as participants in the criminal process, granting them the right to file appeals and cassation complaints. This change ensures that their rights are protected within the framework of the criminal proceedings rather than through separate civil litigation.

A key aspect of this reform is shifting the dispute resolution process for property seizures from civil proceedings to judicial oversight. Unlike civil proceedings, judicial oversight offers a more flexible and expedited mechanism for reviewing materials and resolving disputes. Furthermore, this adjustment prevents potential legal conflicts regarding the prejudicial significance of court decisions in future proceedings.

The Milli Majlis, as the supreme legislative body of Azerbaijan, plays a critical role in harmonizing national legislation with international standards and ensuring the protection of property rights within the judicial system. Following the parliamentary vote, the bill will be submitted for presidential assent.
