Azerbaijan digitizes migration procedures for foreign nationals

The Milli Majlis (National Assembly) of Azerbaijan has adopted, in the final reading, amendments to legislation aimed at digitizing administrative procedures for extending the temporary stay of foreigners and stateless persons in the country.

“Operative Information Center-OMM” reports that the legislative package, which includes amendments to the Migration Code, the Law on Registration at the Place of Residence and Stay, and the Law on State Duty, was discussed during today's plenary session of the parliament's extraordinary session.

Under the new regulations, once the state duty is paid, the decision regarding the extension of stay will be uploaded to the applicant's electronic cabinet within the E-Government Information System and simultaneously sent to their registered email address. Furthermore, the amendments ensure the formalization of these decisions via electronic signatures and clarify the legal framework for digital public services.

The amendments to the Migration Code also introduce additional grounds for refusing an extension of temporary stay. Specifically, the failure to provide one or more of the documents stipulated in Article 41.1 of the Code will now serve as a formal basis for refusal. Conversely, the amendments to the Law on State Duty stipulate that no additional fees will be charged for the re-issuance of a decision regarding the extension of temporary stay.

The legislation also includes transitional provisions. Decisions on the extension of temporary stay issued prior to the law's entry into force will remain valid until their expiration. In cases where such documents are lost, destroyed, rendered unusable, or if the applicant's identification details change, the decision will be re-issued electronically, uploaded to the E-Government Information System, and sent to the applicant's email, with no state duty required for this re-issuance.

Following the parliamentary discussions, the bill was put to a vote and adopted in the third reading. These changes represent a significant step in Azerbaijan's ongoing initiative to modernize public administration and enhance the efficiency of migration management through digital transformation.
