A judge in Nova Scotia has dismissed the sexual assault case against Mike Smith, the actor known for playing Bubbles in the Canadian sitcom “Trailer Park Boys”.

The trial was due to begin in provincial court in Dartmouth on Thursday. After prosecutors presented no evidence, Smith’s lawyers asked the judge to dismiss the case.

Why prosecutors offered no evidence

Prosecutor Bryson McDonald said the Crown had made the decision “based on the Crown’s ongoing assessment that the prosecution standard has no longer been met”. He declined to provide further details, but said his office had remained in regular contact with the complainant.

A publication ban is in place to protect the complainant’s identity. In a statement to Canadian broadcaster CBC, she said the case was dismissed because she was “unwilling to sacrifice my mental health” by testifying.

Smith to resume company duties

Smith, 54, was charged last year in connection with an alleged sexual assault in 2017. In February, he pleaded not guilty to one count of sexual assault.

“Trailer Park Boys” Incorporated, the company behind the show, said Smith would resume his responsibilities following the charge being dropped. His lawyer said the actor was “pleased that this matter is now behind him and is ready to move forward”.

Set in a fictional trailer park in Nova Scotia, “Trailer Park Boys” follows three longtime friends who are petty criminals. The mockumentary series first aired in 2001 and ended in 2007 before being revived by “Netflix”. Season 13 is expected to be released in the coming months.
