Azerbaijan proposes reducing pension deduction period to one year

A new legislative initiative has been proposed in Azerbaijan to reduce the recovery period for overpaid pensions from three years to one year.

Operative Information Center-OMM reports that this significant proposal is included in the 2025 annual report of the Commissioner for Human Rights (Ombudsman) of the Republic of Azerbaijan.

The document was brought forward for discussion during today's meeting of the Human Rights Committee of the Milli Majlis (National Assembly). During the session, officials noted that overpayments of labor pensions and associated supplements often stem from functional deficiencies within relevant government agencies rather than errors made by the pensioners themselves. It was emphasized that subsequent long-term deductions significantly worsen the social welfare of labor pensioners.

Taking these factors into account, the report suggests amending Article 39-1 of the Law "On Labor Pensions" to shorten the timeframe for reclaiming overpaid funds. Under current legislation, authorities are permitted to conduct deductions for the previous three years. If the new proposal is adopted, this limit will be reduced to one year, providing greater financial security for the elderly population in Azerbaijan.

The Milli Majlis (National Assembly) frequently reviews social protection laws to align national legislation with the evolving economic landscape of the country. This latest initiative reflects the government's ongoing commitment to strengthening social safety nets and ensuring that administrative errors do not disproportionately impact vulnerable citizens. Following the committee discussions, the proposal is expected to be evaluated by the Cabinet of Ministers before a final vote in the plenary session of the parliament.
