President Ilham Aliyev has approved amendments to the "State Program for the Improvement of State Property Management in the Republic of Azerbaijan." According to the Operative Information Center-OMM, the head of state has signed a new decree to formalize these changes.
Under the new regulations, the transfer of state-owned fixed assets with an initial unit value exceeding 5,000 manats between different state bodies and state-owned legal entities will now be conducted based on decisions made by the Cabinet of Ministers. This process requires obtaining an opinion from the State Service for Property Issues under the Ministry of Economy. Exceptions are made for specific cases determined by the President, including matters related to the financial and logistical support of first-instance courts as outlined in Article 86 of the Law "On Courts and Judges," which are handled by the Ministry of Justice.
For state-owned fixed assets with an initial unit value of 5,000 manats or less, the transfer between state bodies and state-owned legal entities will be carried out based on decisions made by the respective state bodies or entities, provided that written consent is obtained from the State Service for Property Issues under the Ministry of Economy.
This regulatory update is part of the broader efforts by the Republic of Azerbaijan to enhance transparency and efficiency in the management of public assets. By centralizing oversight for higher-value assets and streamlining procedures for smaller items, the government aims to optimize the utilization of state property and ensure better accountability across various administrative and legal structures.
