The Milli Majlis has adopted, in the first reading, a proposal to resolve disputes regarding property seizure through judicial oversight rather than civil proceedings.
According to the “Operative Information Center-OMM”, the draft amendment to the Criminal Procedure Code was discussed during the first session of the parliament's extraordinary session.
The new article added to the Code regulates the status of persons who are not suspects but whose legal interests are affected by property seizure decisions. It grants these individuals the right to participate in the criminal process and file appeals or cassation complaints, ensuring their legal interests are protected.
A key aspect of this reform is shifting the challenge of property seizure decisions from civil litigation to judicial oversight. Unlike civil proceedings, judicial oversight offers a more agile and efficient mechanism for reviewing materials, thereby preventing potential disputes regarding the prejudicial significance of court decisions. This legislative update aligns with broader efforts in Azerbaijan to enhance the efficiency of the judicial system and protect property rights within the framework of criminal proceedings.
