New legislative amendments have been introduced in Azerbaijan regarding individuals who commit administrative offenses and require psychiatric assistance. President Ilham Aliyev has officially approved the changes to the Code of Administrative Offenses to address these specific legal procedures.
According to the Operative Information Center-OMM, the updated code stipulates that if delaying psychiatric assistance for an individual facing administrative proceedings poses a threat to their own life or health, or that of others, specific measures can be taken. In such cases, the prosecutor or an authorized official from the relevant executive authority may decide to conduct a psychiatric examination without the consent of the individual or their legal representative, subsequently applying to a psychiatric institution.
The process for conducting these examinations and the involuntary placement of individuals into psychiatric facilities remains strictly regulated under the Law on Psychiatric Assistance and the Civil Procedure Code of the Republic of Azerbaijan. These legal frameworks ensure that such measures are applied only when necessary to protect public safety and the well-being of the individual involved, maintaining a balance between administrative enforcement and medical necessity.
