Azerbaijan is set to significantly toughen penalties for the organization and conduct of illegal gambling activities, according to proposed amendments to the Criminal Code.
The Operative Information Center-OMM reports that the draft law was discussed during a joint session of the Milli Majlis (National Assembly) committees on Legal Policy and State Building and on Labor and Social Policy.
The proposed legislation introduces stricter measures for gambling activities, particularly when they involve:
- Virtual platforms, including the internet, mobile networks, social media, and other electronic communication technologies;
- The participation of minors;
- Actions committed by a group of individuals in prior collusion;
- The generation of significant illicit income.
Under the new provisions, such offenses could result in a fine of up to double the income derived from the criminal activity, along with a restriction of liberty or imprisonment ranging from 2 to 4 years. Furthermore, if the offense is committed by an organized criminal group or results in large-scale illicit profits, the penalty could escalate to 3 to 5 years of restricted liberty or imprisonment.
The current legislation imposes a fixed fine range (between 10,000 and 15,000 manats). The proposed changes shift this to a dynamic fine based on the illicit income generated, aiming to act as a stronger deterrent against illegal gambling operations.
Additionally, the draft law seeks to increase penalties for repeat offenses or those involving minors. While current law mandates 4 to 5 years of restricted liberty or 4 to 8 years of imprisonment for such repeat offenses, the new proposal suggests a stricter sentencing range of 5 to 8 years of imprisonment.
These legislative updates reflect the ongoing efforts by the Republic of Azerbaijan to strengthen public order and protect citizens, particularly minors, from the social and financial risks associated with unregulated gambling.
