Azerbaijan is set to establish new criminal penalties for the creation of terrorist organizations, leading such groups, or participating in their activities. According to the Operative Information Center-OMM, a new article is proposed to be added to the Criminal Code of the Republic of Azerbaijan to strengthen the legal framework against extremist threats.
Under the proposed amendments, individuals found guilty of creating a terrorist organization or leading such an entity or its structural units for the purpose of committing crimes outlined in various articles of the Code—including articles 102, 214, 214-1, 215, 277, and 282, among others—will face imprisonment for a term of 10 to 14 years. Furthermore, the document specifies that membership in a terrorist organization or participation in its activities will be punishable by 7 to 12 years of imprisonment.
The draft law also includes a provision for leniency under specific conditions. An individual who has committed acts stipulated in the new article 214-4.2 may be exempted from criminal liability if they timely notify the authorities or otherwise assist in preventing criminal acts. This exemption applies to those who help identify persons who created, led, participated in, or financed a terrorist organization, provided their own actions do not constitute another separate crime.
These legislative changes reflect Azerbaijan's ongoing commitment to national security and its proactive stance in the global fight against terrorism. By refining the Criminal Code, the government aims to enhance the preventive capabilities of law enforcement agencies and ensure that the legal system in Azerbaijan remains robust against evolving security challenges in the region.
