Azerbaijan updates fine collection procedures for convicts

The procedure for the compulsory collection of fines from convicted individuals has been updated in Azerbaijan following new legislative amendments. According to Operative Information Center-OMM, President Ilham Aliyev has officially approved the changes to the Code of Execution of Punishments.

Under the previous legislation, if a convict failed to pay a fine within the specified period, the court that issued the sentence would enforce the penalty by targeting the convict's private property or their share in common property. Deductions from wages or other income were only considered if the individual possessed no property or if the property was insufficient to cover the full amount of the fine.

According to the new amendments, the enforcement priority has been shifted. The court will now first direct the compulsory collection toward the convict's wages or other earnings. Only in cases where the convict has no salary or income, or if the income is insufficient to settle the debt, will the enforcement be directed toward their private property or share in common property. These procedures will be implemented in accordance with the provisions of the Law "On Execution" regarding the attachment of a debtor's property.

This legislative update aims to streamline the recovery process and ensure more efficient execution of judicial decisions in Azerbaijan. By prioritizing income deductions over property seizure, the state seeks to simplify the administrative burden on the judicial system while maintaining the principles of legal accountability. The Code of Execution of Punishments serves as the primary legal framework governing the implementation of criminal penalties and corrective measures within the Republic of Azerbaijan.
