Azerbaijan's Supreme Court clarifies rules on invalid marriages

The Civil Chamber of the Supreme Court of the Republic of Azerbaijan has issued a decision establishing a unified judicial practice regarding the subsequent validation of marriages previously considered invalid. According to the Operative Information Center-OMM, the ruling was based on a specific case reviewed by the Supreme Court involving the legal status of a marriage contracted while a prior union was still in effect.

The case materials indicate that a plaintiff sought to invalidate a marriage entered into by their father in 1976, on the grounds that a previous marriage from 1974 had not yet been dissolved. Although the court of first instance initially granted the claim, the appellate court overturned the decision. The court noted that under the relevant legal framework, if the impediment to a marriage is later removed—such as the dissolution of the prior marriage in 2004—the subsequent marriage can be deemed valid. The court further emphasized that the invalidation of a marriage does not affect the rights of children, including their inheritance rights.

In Azerbaijan, the Supreme Court plays a vital role in ensuring the consistent application of the Family Code across the national judiciary. This ruling provides essential legal clarity for civil cases involving complex marital histories, particularly those spanning different legislative eras. By establishing this precedent, the court aims to protect the stability of family relations and ensure that technical legal obstacles do not indefinitely undermine the civil status of individuals once those obstacles have been resolved.
