Azerbaijan adopts new law on child rights

The Milli Majlis (National Assembly) has opened a new chapter in the protection of children by adopting a new draft law "On the Rights of the Child" in its third reading.

According to the Operative Information Center-OMM, the document, which consists of 8 chapters and 63 articles, introduces a series of fundamental innovations in the field of child rights in Azerbaijan.

How the new law ensures the best interests of the child

For the first time in the draft law, a system of concepts related to child rights is being formed, and the principle of the "best interests of the child" is being transformed into a specific legal mechanism. While this principle existed in previous legislation, the rules for its application were not clearly defined. In the new draft, the best interests of the child are established with specific guarantees in a separate article.

It is now a mandatory legal obligation to conduct an investigation, learn the child's opinion, and assess potential negative impacts before any decision regarding a child is made. This ensures the full implementation of the international "best interests of the child" principle within the national legislation of Azerbaijan.

New mechanisms against violence and early marriage

The new draft law clearly classifies forms of violence, including physical, psychological, sexual, corporal punishment, neglect, and internet violence. When signs of violence are detected, teachers, medical workers, and social service employees are under a legal obligation to report it immediately. The medical, psychological, and social rehabilitation of a child who has been subjected to violence is defined as a direct obligation of the state.

The project also defines "early marriage" as a specific concept, creating concrete legal liability. Mechanisms for identifying children in difficult life situations, emergency measures, and repatriation rules are also established. These reforms align with Azerbaijan's ongoing commitment to international human rights standards and the protection of vulnerable populations.

Expansion of children's rights and freedoms

The new draft includes separate articles on every child's freedom of thought and speech, as well as the freedom to receive and obtain information. In child and family relations, parental rights are now limited by the interests of the child. The state will intervene only in necessary cases, and violence is strictly prohibited.

One of the most significant innovations is the recognition of the child as a subject with the right to direct participation in administrative and judicial proceedings. Child-oriented procedures, age-appropriate explanations, and legal aid are regulated by separate articles. This legislative update reflects Azerbaijan's broader social policy goals to modernize its legal framework and ensure the comprehensive development and safety of the younger generation in the Republic.
