Azerbaijan is set to introduce strict fines and criminal penalties for the illegal creation and distribution of materials generated using artificial intelligence (AI) and specialized software. According to the Operative Information Center-OMM, proposed amendments to the Criminal and Criminal Procedural Codes have already been submitted for discussion during a joint meeting of the Milli Majlis (National Assembly) committees on Legal Policy and State Building, as well as Human Rights.
Under the draft law, the creation of photos, videos, or audio materials that do not reflect reality by using a person's image or voice without their consent will be punishable by law. Those who distribute such fake materials through the media, internet information resources, or telecommunication networks face fines ranging from 3,000 to 7,000 manats. Alternative sentencing includes 360 to 480 hours of community service, restriction of liberty for up to three years, or imprisonment for the same term.
The document further specifies that penalties will be intensified if these acts are committed by a group of persons or against two or more individuals. Furthermore, crimes committed with the intent to defame or discredit a person's honor and dignity, or in connection with the victim's official duties, will carry a prison sentence of three to five years. The most severe penalties are reserved for the creation and distribution of pornographic or sexual deepfakes without consent; those found guilty of broadcasting such sensitive content face three to seven years in prison.
In addition to punitive measures, the legislation introduces a mandatory requirement for digital transparency. Any photo, video, or audio material generated via AI technologies must include a special visible label (watermark) clearly indicating that the content was created by artificial intelligence. This move aligns Azerbaijan with global efforts to combat the rise of misinformation and digital identity theft. As AI technology advances rapidly, the Republic of Azerbaijan is proactively updating its legal framework to protect citizens' digital rights and ensure the integrity of the information space in Baku and across the country.
