New regulations approved for vehicle impoundment fee refunds

The Cabinet of Ministers of the Republic of Azerbaijan has officially approved new regulations governing the reimbursement of fees paid by vehicle owners for the transport and storage of vehicles at impound lots. Prime Minister Ali Asadov signed the decree, establishing a clear legal framework for when these costs can be recovered.

According to the Operative Information Center-OMM, the new rules stipulate that vehicle owners are entitled to a refund of storage fees under specific legal circumstances:

  • When proceedings regarding the administrative offense that led to the vehicle being impounded are terminated;
  • When an appeal against an administrative penalty decision is granted in favor of the vehicle owner.

The regulation specifies that if a vehicle remains in the impound lot after the owner has been officially notified of the decision to terminate proceedings or grant an appeal, the fees incurred for that subsequent period will not be refunded.

To initiate the refund process, the vehicle owner must submit a formal application to the authority or official that issued the original administrative protocol or penalty decision. This application must follow the format specified in the annex of the new regulation. Furthermore, decisions made by the relevant authority regarding these applications can be appealed through administrative or judicial channels.

These new regulations apply to all guarded vehicle impound lots operating across the territory of Azerbaijan. This move is part of broader efforts by the government to streamline administrative procedures and protect the rights of vehicle owners in cases where administrative penalties are overturned or deemed invalid.
