Azerbaijan's Cabinet of Ministers has adopted a significant decree amending the "Instruction on the rules for performing notary acts" dated September 11, 2000, to streamline property registration and enforcement procedures.
According to Operative Information Center-OMM, Prime Minister Ali Asadov signed the new order to modernize the legal framework surrounding asset transfers. Under the new regulations, notaries will now issue certificates for the acquisition of real estate and movable property registered in official registries in connection with the compulsory execution of enforcement documents.
Furthermore, in cases and within timeframes established by the Law "On Execution," when property is sold on the open market based on a purchase and sale agreement formalized through a notary, the notary will transfer the proceeds from their deposit account to the deposit account of the executive service. This measure is designed to increase transparency in the settlement of debts and the transfer of ownership during judicial or administrative enforcement actions.
These legislative updates in Azerbaijan aim to simplify bureaucratic procedures for citizens and legal entities while ensuring more efficient oversight of property transactions. By integrating notary services more closely with enforcement mechanisms, the government seeks to reduce delays in the execution of court decisions and improve the overall business climate in the country.
