The Constitutional Court of Azerbaijan has issued a ruling regarding the interpretation of the Code of Criminal Procedure, while also recommending that the Milli Majlis (National Assembly) optimize the deadlines for filing cassation complaints.
According to the Operative Information Center-OMM, the decision was announced during a plenary session of the Constitutional Court chaired by Farhad Abdullayev. The court examined a request from the Prosecutor's Office of the Republic of Azerbaijan concerning the interpretation of Article 420 of the Code of Criminal Procedure in conjunction with Articles 65.1, 142.1, and 397. The ruling mandates that when an appellate court's verdict is partially overturned, the new appellate review must be limited to the specific parts overturned by the cassation court. Furthermore, it emphasizes that appellate courts must adhere to the instructions provided by the cassation court within the limits defined by the Code of Criminal Procedure.
